Lawyer of Swapna Suresh Faces Case for Hurting Religious Sentiments

Kerala Police said, on Saturday, that it has registered a case not released on bail against lawyer Swapna Suresh, who is accused in the case of smuggling gold through diplomatic channels, for allegedly harming religious sentiments via social media. The lawyer was facing the case of the post he posted on May 25 on social media criticizing the uniform of the driver of a state-run bus. A complaint against the lawyer alleged that the publication disparaged a particular religion.

The complaint stated that the lawyer falsely claimed that the driver of the station was wearing a white robe and that he was insulting a certain religion. “We need to verify the identity of the attorney,” a senior police official in the area told PTI. Police said the case was registered under various sections including Section 295A of the Indian Penal Code. The section deals with intentional and malicious acts intended to provoke the religious sentiments of any group by insulting their religion or religious beliefs.

A photo of the driver went viral, and several right-wing social media, including that of BJS President K. Surendran, claimed that the driver was not wearing a uniform but rather a white robe. It is a traditional Islamic dress. Later, Kerala State Road Transport Corporation (KSRTC) clarified that the driver was wearing a sky blue shirt which is its staff uniform and that the photo looked like a robe due to the angle at which the photo was taken.

Swapna Suresh, who met with the media, claimed that the case was registered against her lawyer after it was “recently revealed in the gold smuggling case” against Kerala Chief Minister Pinarayi Vijayan and his family. “Why didn’t they register a case when the post appeared on Facebook? Why are they doing that now? I can’t change lawyers every now and then…” Suresh said.

She inquired about the timing of the recording of the case a day after she released audio clips of her alleged conversation with a man, she said, with links to influential people in the government. She said she released the audio recording to “prove” her claim that he approached her to “settle” issues arising after her statement to the Magistrate’s Court recently regarding the alleged role of Prime Minister Pinarayi Vijayan and his family members in some of the alleged smuggling operations. activities.

In the alleged audio clips, the man named Shaj Kiran, a former doctor, was heard asking Suresh why she had given testimony to the court under Section 164 of the Criminal Procedure Code, and said that the Prime Minister would not tolerate her statements targeting his family members in relation to a particular smuggling case. “Kiran told me that Sarith will be arrested. It happened. He said Sarith will release her soon. This also happened. Kiran also said that my lawyer will be in trouble. Now a case has been registered against my lawyer.

She appealed to the media, saying: “Do not hurt those around me.” “Now that a case is registered against my lawyer, does anyone else come to my defense? I have already been designated a terrorist…I want to live…” she said.

Sparking a political storm in the state, Suresh claimed, earlier this week, that she had disclosed in court – in her statement under Section 164 of the Criminal Procedure Code – the other persons allegedly involved in smuggling cases and their “degrees of involvement”. She said she had made statements against the Prime Minister, his family, former Kerala minister KT Jalil and some other senior bureaucrats. Suresh, a former employee of the UAE consulate here, was detained by the National Investigation Agency (NIA) along with another accused, Sandeep Nair of Bengaluru on July 11, 2020.
