HC allows DHFL promoter Wadhawan to visit pvt hospital for surgery follow-up

The Bombay High Court on Friday allowed DHFL promoter Dheeraj Wadhawan to visit Kokilaben Ambani Hospital to pursue nose surgery on Monday 23 May. The order came during a hearing on his urgent provisional application against a special court order from the CBI.

Wadhwan was arrested by the Central Bank of Iraq in 2020 in connection with the Yes Bank case. Later, he was arrested by the Execution Directorate.

On April 8, Wadhawan was allowed to undergo nose surgery at Kokilaben Dhirubhai Ambani Hospital, the health center said he will be admitted to the hospital for surgery and post-operative care for two weeks.

The Supreme Court had overturned the CBI special court order against Wadhawan, which ordered him to be transferred to the state-run JJ Hospital from a private hospital in Mumbai where he was kept for 15 months before being transferred to Taloja Central Jail in March. 25.

“After the specified period, Wadhwan is transferred to Taluja Central Prison and in case of necessity, is transferred to JJ Hospital / KEM Hospital. The petition has been adjudicated… The CBI court order has been rescinded,” the court had held. On Friday, Wadhawan’s attorneys told Judge Milind N Jadhav’s Vacation Authority that after the surgery, doctors at Kokilaben Hospital asked him to come in for a follow-up visit.

The court noted that Wadhwan’s discharge summary from the private hospital stated that he was required to visit the hospital to follow up on ear, nose, throat, cardiology and urology after his discharge.

But the prison authorities refused, saying that the court order does not provide for such follow-up visits, and if there is a need, he can be transferred to a government or civil hospital. Transfer and paint the leave seat for clarifications on the same. On Friday, the judge allowed Wadwan to visit the private hospital. Moreover, the judge gave him the freedom to move HC in case he was asked to go to any other follow up.

Wadhwan pointed to another medical problem related to his urinary system, saying it requires attention. However, the prison authorities made it clear that JJ Hospital has facilities to examine and treat him if necessary and he can be moved there.
