The Lucknow Court of the Allahabad High Court on Friday refused to overturn the FIR report against University of Lucknow Professor Ravi Kant Chandan over his remarks on Kashi Vishwanath Temple. However, the court ordered the Hasanganj Police not to arrest Chandan without complying with the provisions of the Code of Criminal Procedure.

The FIR was filed against the professor for allegedly harming the religious sentiments of Hindus among other charges based on a complaint by Akhil Bharatiya Vidyarthi Parishad, the student wing of Rashtriya Swayamsevak Sangh. He was accused of making objectionable comments about the Kashi Vishwanath Temple-Gyanvapi complex in Varanasi during an online debate. Court of Justice Arvind Kumar Mishra and Justice Manish Mathur issued the order on the petition filed by Prof.

It was said on behalf of the professor that the offenses alleged in the FIR are punishable by a maximum of seven years imprisonment but the police were lobbying for his arrest without complying with the provisions of Section 41(1)(b) read with Section 41(a) of the CRPC . These provisions authorize the police not to arrest the accused without notifying the accused and obtaining an order from the competent court.

Earlier, the court said that the relevant FIR revealed an identifiable crime and therefore there was no opportunity for the court to overturn the FIR report. Chandan was assaulted by a student on campus on Wednesday, days after he sparked controversy with his remarks about the temple.
